These Terms & Conditions (“Terms”) form a legally binding agreement between Kustom Space (“Kustom Space”, “we”, “us” or “our”) and you (“you” or “user”) regarding your access to and use of the website www.kustomspace.ae (the “Website”) and any products or services offered through it.

By accessing or using the Website, placing an order, or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Website or our services.

We may update these Terms from time to time. The latest version will always be posted on this page. Your continued use of the Website after any changes constitutes acceptance of the updated Terms. We encourage you to review them periodically.

1. Eligibility & Accounts

1.1 To place an order or create an account you must be at least 21 years old. If you are under 21, you may only use the Website under the supervision of a parent or legal guardian who agrees to these Terms on your behalf and accepts full responsibility for your use.

1.2 You may register for an Account or place orders as a Guest. Accounts are personal and non-transferable. You must provide accurate, current and complete information and keep it updated.

1.3 You are responsible for maintaining the confidentiality of your Account credentials and for all activity under your Account. Notify us immediately of any unauthorised use. We may suspend or terminate Accounts at our discretion if we suspect misuse or security issues.

2. Services & Products

Our Services include:

Access to the Website to browse and purchase products (curtains, blinds, flooring, carpets, custom furniture, wallpaper, and related items);
Arrangement of delivery and/or professional installation through our logistics and installation teams;
Customer support via email, phone and WhatsApp.

We also offer interior design, custom manufacturing, measurement and installation services. Specific project terms may be set out in separate quotations or contracts.

3. Orders, Pricing & Payment

3.1 All prices are shown in United Arab Emirates Dirhams (AED) and include applicable VAT unless otherwise stated. Shipping and installation charges (if any) will be displayed at checkout or in your quotation.

3.2 By placing an order you agree to pay the full amount shown, including any delivery or installation fees. We accept major credit/debit cards and other payment methods displayed on the Website. Payments are subject to authorisation by your card issuer.

3.3 We reserve the right to refuse or cancel any order for any reason, including stock unavailability, pricing errors, payment issues, shipping restrictions, or suspected fraud. If we cancel an order after payment has been taken, we will refund you.

3.4 Online prices may differ from in-store prices. We may limit quantities per customer, household or order at our discretion.

3.5 You warrant that all billing and delivery information you provide is accurate. Providing false information is a breach of these Terms.

4. Shipping & Delivery

4.1 You are responsible for providing a complete and accurate delivery address. Risk of loss and title pass to you upon delivery by our team (or collection if applicable).

4.2 Delivery times are estimates only and may vary by product, location and stock. We deliver across the UAE (subject to serviceable areas). Free-zone and certain non-service areas may take longer.

4.3 We are not liable for delays, loss or incorrect delivery caused by inaccurate information you provide or your unavailability.

4.4 Please inspect products on delivery. Report any visible damage or defects immediately to the delivery team or contact us within a reasonable time.

5. Returns, Exchanges & Refunds

5.1 We want you to be satisfied. You may cancel an order at any time before delivery/installation.

5.2 After delivery you have 7 days to return eligible items, provided they are unused, in original condition and packaging, with tags and invoice. Customised, made-to-measure, installed, hygiene-related or clearance/sale items are generally non-returnable unless defective.

5.3 Returns of damaged or defective items must be reported promptly with photos. Contact us via email or WhatsApp to arrange collection.

5.4 Approved refunds are processed to the original payment method (usually within 4–8 working days after we receive and inspect the item). Bank processing times may add further delay. We do not offer cash refunds; cash payments are refunded by cheque where applicable.

5.5 Shipping and Cash-on-Delivery charges may be deducted from refunds for partial returns.

6. User Content

If you submit reviews, comments, photos or other content (“User Content”):

You confirm it is original and does not infringe any third-party rights.
You grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and distribute that content in any medium.
You will not post unlawful, defamatory, offensive, spam or infringing material.
We may (but are not obliged to) monitor, edit or remove User Content at our discretion.
You remain solely responsible for your User Content and agree to indemnify us against any claims arising from it.

7. Intellectual Property

All content on the Website (text, images, logos, designs, software, etc.) is owned by or licensed to Kustom Space and protected by UAE and international intellectual-property laws. You may not copy, reproduce, modify, distribute or commercially exploit any content without our prior written consent, except for personal, non-commercial use.

8. Privacy & Cookies

We collect and process personal information in accordance with our Privacy Policy. By using the Website you consent to our use of cookies and similar technologies as described in the Privacy Policy.

9. Disclaimer of Warranties

To the fullest extent permitted by UAE law, the Website and Services are provided “as is” and “as available”. We do not warrant that the Website will be uninterrupted, error-free or free from viruses. Product descriptions and colours are approximate; actual products may vary. Manufacturer warranties (if any) apply separately.

10. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded under UAE law (including for fraud or personal injury caused by negligence).

To the maximum extent permitted by law:

We are not liable for any indirect, incidental, special or consequential damages (including loss of profits, data or goodwill).
Our total liability for any claim arising from a product or service is limited to the amount you paid for that specific product or service.

11. Indemnity

You agree to indemnify and hold harmless Kustom Space, its directors, employees, agents and affiliates from any claims, losses, damages or expenses (including legal fees) arising from your breach of these Terms, your use of the Website or Services, or your violation of any law or third-party rights.

12. Termination

We may suspend or terminate your access to the Website or Services at any time, with or without notice, for breach of these Terms or for any other reason. Provisions that by their nature should survive (including intellectual property, liability limitations and indemnity) will continue to apply.

13. Force Majeure

We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, epidemics, government actions, strikes, power failures, internet outages or third-party service disruptions.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

15. General

15.1 These Terms (together with the Privacy Policy, Returns Policy and any specific quotation or order confirmation) constitute the entire agreement between you and Kustom Space regarding the subject matter.

15.2 If any provision is held invalid or unenforceable, the remaining provisions continue in full force.

15.3 Our failure to enforce any right does not constitute a waiver.

15.4 You may not assign these Terms without our prior written consent.

15.5 Links to third-party websites are provided for convenience only; we are not responsible for their content or practices.
